Terms and Conditions of Use

 

4RACING IS A LICENSED BETTING OPERATOR REGULATED BY THE GAUTENG GAMBLING BOARD. THESE TERMS OF USE GOVERN THE OFFERING AND ACCEPTANCE BY 4RACING OF BETS PLACED BY YOU USING THE CREDIT IN YOUR WALLET.

 

BY ACCEPTING THE TERMS OF USE, PLACING A BET OR ACCESSING THE WEBSITE, YOU CONFIRM THAT YOU HAVE READ, UNDERSTAND AND AGREE TO THE TERMS OF USE AND THAT YOU ARE 18 YEARS OF AGE OR OLDER.

IF YOU ARE UNDER THE AGE OF 18 OR DO NOT AGREE WITH THE TERMS OF USE, YOU MAY NOT ACCESS THE WEBSITE OR PLACE ANY BETS.

 

YOUR ATTENTION IS SPECIFICALLY DRAWN TO CLAUSES 2.8 AND 9 WHICH LIMIT THE RISK AND LIABILITY OF 4RACING.

 

1 Definitions

1.1 “4Racing” refers to 4Racing Proprietary Limited, a private company duly registered in terms of the laws of the Republic of South Africa with registration number 2020/099054/07, with its registered office at Turffontein Racecourse, 14 Turf Club Street, Turffontein, Johannesburg, 2190.

1.2 “Bets” refers to totalisator bets staked on the outcome of an event or a combination of events.

1.3 “Bookmaker” refers to the licensed bookmaker integrated with 4Racing: (i) with whom you have registered an account; (ii) has assigned you a UUID; and (iii) which hosts the Wallet that you use to place your Bets.

1.4 “Business Day” refers to any day which is not a Saturday, Sunday or official public holiday in the Republic of South Africa.

1.5 “Cookies” refers to small pieces of information stored on your hard drive which help you to navigate the Website as easily as possible.

1.6 “Content” refers to all information, content, videos, products, text and/or other materials embedded, displayed or made available on the Website from time to time.

1.7 “GGB” refers to the Gauteng Gambling Board

1.8 “Personal Information” refers to personal information as defined in the Protection of Personal Information Act, 4 of 2012.

1.9 “Privacy Policy” refers to 4Racing’s privacy policy, a copy of which is available on the Website.

1.10 “The Terms of Use” refers to the terms and conditions set out in this document and the Totalisator Rules.

1.11 “Totalisator Rules” refers to the totalisator rules, approved by the GGB and published by 4Racing from time to time which apply to all Bets placed with 4Racing, a copy of which is available on the Website.

1.12 “UUID” refers to your electronic unique user identifier assigned by the Bookmaker.

1.13 “Wallet” refers to the electronic account facilities provided by the Bookmaker to enable you to place Bets using the Bookmaker’s client facing web, app and mobi software applications, and which hold the balance of monies you have available to place such a Bet.

1.14 “Website” refers to, and includes any part or element of, www.tab4racing.com.

 

2 Authorisation

You hereby acknowledge and agree as follows:

2.1 All Bets placed by you using your Wallet are staked directly with 4Racing and the Bookmaker concerned is not an agent of, nor a party to such Betting transactions.

2.2 All Bets are governed by and will be paid out in accordance with the Totalisator Rules.

2.3 Your Wallet is maintained by the Bookmaker and governed by the Bookmaker’s terms and conditions.

2.4 Any refunds, dividends or other amounts due to you in terms of the Totalisator Rules will be credited to your Wallet and paid to the Bookmaker in South African Rands. To this end, you warrant to 4Racing that the Bookmaker is duly authorised to debit and credit your Wallet with the amounts staked by you with 4Racing and any winnings due to you by 4Racing.

2.5 Payment by 4Racing to the credit of your Wallet with the Bookmaker of any winnings or refunds due to you in terms of the Totalisator Rules will discharge any indebtedness by 4Racing to you in full. Proof of payment of the amounts concerned by 4Racing to the Bookmaker will be conclusive evidence of such discharge.

2.6 You will not, under any circumstances, allow any third party to gain access to or use your Wallet to place Bets with 4Racing.

2.7 If you are situated outside of South Africa, it is your responsibility to ensure that the laws of the territory in which you are situated do not prohibit you from placing a Bet with 4Racing.

2.8 To the extent that the Website contains links to third party websites, services and resources, 4Racing does not control the availability and content of those third party websites, services and resources. Your use of such other websites, services and resources are entirely at your own risk and 4Racing is not responsible for any claim for loss or damages, whether direct, indirect or consequential, arising from your use of such other websites, services and resources or your reliance on any information contained therein.

 

3 Dispute Resolution

3.1 Any dispute that you wish to raise concerning a Bet placed by you (“Dispute”) may either be logged through the Bookmaker’s Help Desk (“BHD”) or directly with 4Racing via [email protected], or the GGB: at

3.2 In the event that you log a Dispute through the BHD, the Dispute will be referred by the Bookmaker to 4Racing in accordance with the procedure agreed between them from time to time and you will receive a ticket from the Bookmaker in response. Alternatively, if you log a Dispute directly with 4Racing, you will receive the ticket from 4Racing directly (a copy of the ticket will be provided to the Bookmaker).

3.3 Following the logging of a Dispute or the referral of a Dispute from the Bookmaker, 4Racing will investigate and endeavour to reach a decision on your Dispute within 12 business hours of receipt of the notification of the Dispute.

3.4 If you logged the Dispute through the BHD, the outcome of the Dispute will be notified to you by the Bookmaker. Otherwise, 4Racing will contact you directly to notify you of the outcome of the Dispute.

3.5 If you are happy with the outcome of the Dispute, your ticket will be marked as resolved. If you are not happy with the outcome of the Dispute, you may send an e-mail to [email protected] with the ticket number as reference informing 4Racing of your dissatisfaction with the outcome and the reasons therefor.

3.6 4Racing will contact you to try to resolve the Dispute. If the Dispute is not resolved, you will be informed of your right to lodge a customer dispute with the GGB.

4 Use of the Website and the Content

You undertake to:

4.1 use the Website and the Content only for the purposes for which they are intended and in accordance with the Terms of Use, and for no other purpose;

4.2 not reverse engineer, decompile or disassemble the Website, or attempt to do so;

4.3 not attempt to gain unauthorised access to the Website or related systems or networks;

4.4 not copy the Website and the Content or any part, function or feature thereof;

4.5 not circumvent, remove, alter, deactivate, degrade or thwart any of the protections in respect of the Website or the Content; and

4.6 not use any code, software or device to interfere or attempt to manipulate the Website or any part, function or feature thereof and/or interfere with its proper working.

 

5 Intellectual Property Rights

5.1 The Website and the Content are proprietary to 4Racing. Except as provided for in the Terms of Use, no licence or any other right is granted to you in respect of the Website and the Content and you will not permit any third party to archive, download (other than through caching necessary for personal use), reproduce, distribute, modify, display, create derivative works from the Website and the Content without 4Racing’s prior written consent.

5.2 You acknowledge and agree, as between you and 4Racing:

5.2.1 All intellectual property rights in and to the Website and the Content, including all source information, data and code, vest in 4Racing.

5.2.2 You will not, and shall not, permit or assist any third party to infringe 4Racing’s rights in and to the Website and the Content.

5.2.3 You will not challenge, question or dispute 4Racing’s right, title and interest to any of its intellectual property rights in and to the Website and the Content, nor the ownership thereof or assist any other person or entity to do so.

 

6 Privacy and Data Collection

6.1 4Racing will only receive and process your Personal Information in limited circumstances, such as in the event of a Dispute, if it is required to do so in law, or where you disclose your Personal Information to 4Racing.  

6.2 4Racing receives, processes and secures your Personal Information in accordance with its Privacy Policy. You hereby confirm that, as the party providing Personal Information, you agree to the terms of the Privacy Policy and undertake to be bound by the provisions thereof.

6.3 You consent to the processing of your Personal Information by 4Racing for purposes of these Terms of Use.

6.4 4Racing does not and will not assume any obligations with respect to your Personal Information or the use of your Personal Information other than as set out in these Terms of Use, the Privacy Policy or in terms of any applicable laws.

 

7 Cookies

In accordance with its Privacy Policy, 4Racing might store certain information on your computer in the form of a Cookie or similar file, when you view or access the Website. You have the option of setting your browser to reject Cookies. However, doing this will hinder performance and negatively impact your experience on the Website.

 

8 Suspension

4Racing shall be entitled, with or without notice, to suspend the processing of any Bet placed by you and report you to the relevant authorities, if you engage in any activities which, in 4Racing’s sole discretion, would constitute a breach of these Terms of Use, contravention of any law and/or a violation and/or infringement of any rights of a third party.

 

9 Disclaimer

The Website and the Content are provided "as is" without any warranties, including but not limited to express or implied warranties of merchantability, fitness for a particular purpose, compatibility of the Website or Content with your software or devices, title and non-infringement or about their suitability, reliability or accuracy.

 

10 General

10.1 Whole Agreement: The Terms of Use constitutes the whole agreement between you and 4Racing in relation to all transactions concluded between the Parties and no agreement, representations or warranties between the parties, other than those set out herein are binding on the parties.

10.2 Applicable Law and Jurisdiction: The Terms of Use shall be governed by and interpreted in accordance with South African law. You consent to the jurisdiction of South African courts and agree that any dispute arising out of the Terms of Use or the interpretation thereof, both while in force and after its termination howsoever arising shall be submitted to and determined by a court of law in the Republic of South Africa.

10.3 Changes: 4Racing may, from time to time, and in its sole discretion, amend the Terms of Use. Such changes will be effected by way of publication thereof on the Website, and you waive any right you may have to receive specific notice of such changes or modifications.

10.4 Waiver: No latitude, extension of time or other indulgence which may be given or allowed by 4Racing to you in respect of the performance of any obligation or enforcement of any right arising from the Terms of Use and no single or partial exercise of any right by 4Racing shall under any circumstances be construed to be an implied consent by 4Racing or operate as a waiver or a novation of, or otherwise affect any of 4Racing’s rights in terms of or arising from the Terms of Use or estop 4Racing from enforcing, at any time and without notice, strict and punctual compliance with each and every provision of the Terms of Use.
